1. Acceptance of terms

Using the FitApp website, application, or related services means you have read and accepted these terms and conditions.

If you do not agree with any part of these terms, you must stop using the services.

2. Definitions

• “FitApp” means the FitApp digital platform and related website services.
• “User” means any visitor or registered person using the website or app.
• “Customer” means a gym, coach, or organization purchasing FitApp services.
• “Athlete / student” means an end user receiving training plans through a gym or coach workspace.

3. Service description

FitApp provides digital tools for gym and coaching operations, including:

• Athlete panels for workouts, nutrition, rest, progress and messaging
• Coach panels for student management, plans and follow-up
• Gym panels for coach teams, tariffs and operational reporting

4. Registration and accounts

Users are responsible for the accuracy of registration information and for keeping login credentials secure.

• Providing false or incomplete information may lead to account restriction
• Each user must protect their password and account access
• Unauthorized use of another person’s account is prohibited
• FitApp may suspend accounts that violate these terms or applicable law

5. User obligations

When using FitApp, users must:

• Comply with Iranian laws and public order rules
• Avoid uploading illegal, harmful, fraudulent or abusive content
• Respect other users’ privacy and intellectual property
• Use the platform only for legitimate fitness and coaching purposes

6. Payments and pricing

Fees for FitApp services are shown before purchase or in the related service agreement.

• Payments for platform / SaaS plans are made through the announced payment methods
• Prices, packages and billing periods may change with prior notice where required
• Athlete membership fees collected by a gym remain under that gym’s own commercial rules unless otherwise agreed in writing

7. Cancellation and refunds

Refund requests for FitApp platform fees are reviewed based on activation and delivery status.

• If a purchased FitApp workspace has not been activated and no coaches/students were onboarded, a full refund may be requested within 7 days of payment
• After activation or after coaches/students are created, fees for the started service period are generally non-refundable
• Billing errors or duplicate FitApp charges are corrected after verification

8. Privacy and personal data

FitApp processes account and service data to provide coaching and support features.

• User data is used for service delivery, support and security
• Access to data is role-based according to gym, coach and athlete permissions
• Users should avoid sharing sensitive personal data outside secure account channels

9. Intellectual property

All FitApp trademarks, software, UI designs, content and logos belong to FitApp or its licensors. Copying, reselling or reverse-engineering without written permission is prohibited.

10. Limitation of liability

FitApp provides a software platform and does not replace medical advice or in-person coaching judgment.

• Users are responsible for safe training practice and for decisions made with their coach or gym
• FitApp is not liable for indirect damages arising from misuse, network issues beyond its control, or third-party services
• Service availability is provided on a commercially reasonable basis and may be interrupted for maintenance or force majeure

11. Governing law and disputes

These terms are governed by the laws of the Islamic Republic of Iran. Any dispute related to FitApp services shall first be addressed through FitApp support and, if unresolved, through competent Iranian authorities or courts.
